1. About these terms
These terms apply to your use of the Superwebtech website and its pages. They are written for a company website that presents information about services, products and insights. They do not create a contract for services, and they do not replace a signed agreement.
We may update these terms. The date at the end of this page is the last time it was changed, and the updated terms apply from the moment they are published.
2. When a signed client agreement applies
These terms apply to your use of this website. They do not apply to work we do for you.
Where we have signed a written client agreement with you, that agreement governs the project and these terms do not override it. The signed agreement takes priority over anything on this page for each of the following: the scope of the work; the fees, invoicing and payment terms; how work is reviewed and accepted; any warranties or service levels; what is delivered, and when; and responsibility for the project.
Where the signed client agreement and this page conflict, the signed client agreement wins. Where the signed client agreement is silent, these website terms may still apply to your use of the website itself — but not to the project, which is governed by that agreement.
3. The content is information, not advice
Everything published here — service descriptions, architecture explanations, insights, comparisons, estimates of effort and any other statement — is general information. It is not legal, financial, security or engineering advice, and it is not a recommendation to adopt any particular technology, supplier or approach.
Technology decisions depend on your own requirements, constraints and existing systems. Talk to us about your specific situation before you act on anything you read here, and take independent advice where the subject matter requires it.
We take care with the accuracy of this content, but we do not promise that it is complete, current for your circumstances, or free of error.
4. Products and availability
Some products, tools and platforms described on this website are in development, in early access, in private preview, or being piloted with clients. A product appearing on this site does not mean it is generally available, and it does not mean it will be released.
Products and features described here may change, be renamed, be delayed, or be withdrawn. A product described as in development remains in development until it is actually released; nothing on this page is a commitment that it will be. Availability, pricing, scope and timelines are agreed for each engagement in a separate written agreement, and nothing on this website is an offer, a quotation, or a commitment to deliver.
Where we describe a capability, we describe our intent for that capability at the time of writing.
5. Our content and intellectual property
The website, including its design, layout, text, graphics, code, articles, illustrations and the Superwebtech name and logo shown on it, belongs to Superwebtech (OPC) Pvt Ltd or to our licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to view the pages and to print or download extracts of them for your own internal business reference.
That licence does not permit you to republish substantial parts of the site, to use our content to train or fine-tune machine-learning models, to remove or obscure any copyright or ownership notice, to imply endorsement or association, or to use the site to build a competing product. Our name and logo may not be used to promote another business without our written permission.
Content written by our team about our own products and work remains ours. Where we quote or reference someone else's material, that material remains the property of its owner.
6. Acceptable use
You may use this website for lawful business purposes. You agree not to:
- Use the site for anything unlawful, or to plan, encourage or facilitate unlawful activity.
- Attempt to reach any part of the site that is not intended for public use, including the private enquiry-management area, the content studio, or the site's underlying systems and configuration.
- Probe, scan, overload, flood, scrape at scale, crawl, or otherwise interfere with the operation, security or availability of the site or of other users.
- Introduce malicious code, or attempt to inject content into any page.
- Copy or republish the site's content in bulk, or use automated extraction to build a competing service or dataset.
- Submit false, misleading, automated or unsolicited content through the enquiry form, use the enquiry form to send marketing, or impersonate anyone.
- Attempt to interfere with the enquiry records, or to access enquiry information that is not yours.
- Misrepresent your identity, your affiliation, or the source of any content you submit.
7. Enquiries you send us
An enquiry through the website is a request for information, not an instruction to begin work and not an acceptance of a proposal. We are not obliged to respond, and we may decline or delete an enquiry, in particular where it appears to be spam or where these terms have been broken.
You must be entitled to give us the information you submit, and you confirm that the information is accurate and does not infringe anyone else's rights. Please do not send us confidential information belonging to someone else, personal information about another person, or anything you are not permitted to share.
8. External links and third-party services
This website links to other websites and services, including our scheduling provider. We do not control those sites and we are not responsible for their availability, accuracy, content, security or privacy practices.
A link to a third-party site is a reference only. It does not mean we endorse, recommend, operate or have any responsibility for that site. Where you follow a link you leave this website and the third party's own terms and privacy policy apply.
9. Availability and changes to the site
Pending legal review: This section is a draft and has not been reviewed by a lawyer. The company has considered a stronger guarantee of availability and error-free operation and has not adopted it, because it has not been settled against the company's actual circumstances. Until that review is done, nothing on this page promises availability.
We may change, suspend, or withdraw any part of this website at any time, with or without notice. We do not promise that the site will always be available, that any page will be uninterrupted, or that it will always be free of errors. We may also correct or remove content that is out of date or inaccurate.
10. Disclaimers
Pending legal review: This is a draft disclaimer and has not been reviewed by a lawyer. It does not remove, and must never be read as removing, any right or responsibility that applicable law does not allow us to exclude or limit.
The website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty that the site will be uninterrupted or error-free.
We do not warrant that content on this website is accurate, complete, up to date, or suitable for your specific purpose, and we do not warrant that the site is free of defects or of anything that may harm your device or data. You are responsible for deciding whether the content is appropriate for your use and for protecting your own systems and data.
11. Limits of responsibility
Pending legal review: This is a draft and has not been reviewed by a lawyer. The cap wording, the exclusion of indirect and consequential loss, and the position once a client has accepted delivered work are all unsettled, and the company holds no liability insurance. Nothing here is a limit on any responsibility that applicable law does not allow us to limit.
Nothing in these terms excludes or limits our responsibility for anything that cannot lawfully be excluded or limited.
Subject to that, and to the fullest extent permitted by law, we are not responsible for loss arising from your use of, or inability to use, this website or any linked site, and we are not responsible for any indirect or consequential loss, loss of profit, revenue, business, anticipated saving, data or goodwill, or any loss that is not a direct, foreseeable consequence of the relevant breach.
Where responsibility cannot be excluded, our total aggregate responsibility to you for anything connected with your use of this website is limited to the fees you actually paid us for website-related work in the twelve months before the event giving rise to the claim — unless applicable law requires a higher limit, in which case that higher limit applies.
This section concerns your use of this website only. It does not govern work we do for you: that is governed by the signed client agreement, and section 2 explains how the two relate.
12. Intellectual property concerns
If you believe content on this website infringes your rights, contact us at [email protected] with enough detail for us to identify the content. We will investigate and, where appropriate, remove the content. Repeated or bad-faith infringement claims will not be entertained.
13. Privacy
How we handle information you send through this website is set out in our Privacy Policy, which forms part of these terms: [email protected] will also send you a copy on request.
14. General
Pending legal review: The governing law and forum wording above is the company's stated intention only, and the final clause is deliberately not published until a lawyer has approved it.
These terms are the entire agreement between you and us in relation to your use of this website, and they replace any earlier statement about the website. If a provision of these terms is found unenforceable, the rest continues to apply. A failure by us to enforce a provision is not a waiver of it. Your use of the site is subject to these terms and you accept them by using it.
The law we intend these terms to be governed by is the law of India, and the forum we intend a dispute to be heard in is the courts at Delhi, in the National Capital Region of India.
That is our stated intention rather than a final position, and it is not in force: this page publishes no exclusive jurisdiction clause, and the wording above has not been reviewed by a lawyer. Until the position is finalised, a dispute is governed by whichever law a court with authority over it applies, and nothing here prevents you from approaching a court that would otherwise have jurisdiction.
Where applicable law gives you the protection of mandatory local consumer rights, nothing here removes it.
15. Contact
